I. OVERVIEW

Please read these Terms of Service (“Terms”) carefully before downloading, installing, or using the Speaker Test - Tone Generator mobile application (the “App”). These Terms constitute a legally binding agreement concluded between you and Changsha Zhilan Technology Co., Ltd (“we,” “us,” “our,” or “the Company”). By downloading, installing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not accept the Terms, do not install or use the App.

II. LICENSE

We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to download and use one copy of the App on a device that you own or control, strictly in accordance with these Terms.

III. CORE CONDITIONS

1. Personal, non-commercial use — You may use the App only for your own private

purposes.

2. No redistribution or resale — You may not distribute, rent, lease, lend, sell, sublicense, or otherwise make the App available to third parties.

3. Legal compliance — You are solely responsible for ensuring that your use of the App complies with all local laws and regulations.

4. Prohibited conduct — You may not:

○ use the App in any unlawful, harmful, or fraudulent manner;

○ reverse-engineer, decompile, disassemble, translate, or create derivative works from the App or any accompanying documentation;

○ modify or tamper with the App’s sound-generation routines so as to damage

hardware or hearing.

5. Updates — We may modify, update, or discontinue the App (or any part of it) at any time without notice.

6. Breach — We reserve all legal rights and remedies if you breach these Terms.

IV. INTELLECTUAL PROPERTY

All rights, title, and interest in and to the App (including all software code, sounds, graphics,and branding) are and will remain our exclusive property or that of our licensors. Nothing in these Terms transfers any intellectual-property rights to you except the limited licence above. The App may incorporate open-source components licensed under their respective licences. Details are available within the “About” screen.

V. CHARGES

● Free core functionality — Ejecting water using default frequencies is free.

● Trial — If we offer a free trial for paid features, the upgrade is charged once at the end of the trial unless you cancel through your App-Store account settings at least 24 hours before the trial ends.

● Store rules — All billing is handled by the platform provider (e.g., Apple). You are responsible for any charges or mobile-data fees imposed by your carrier or payment provider.

VI. PRIVACY POLICY

Your use of the App is also governed by our Privacy Policy. Please review it to understand what limited data we collect and how we handle it.

VII. DISCLAIMER

The App is provided “as is” and “as available” without warranties of any kind, whether express or implied (including warranties of merchantability, fitness for a particular purpose, non-infringement, or error-free operation). We do not guarantee that the App will always function uninterrupted or be free of defects.

VIII. LIMITATION OF LIABILITY

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of data, device damage, or hearing impairment) arising out of or related to your use of—or inability to use—the App. You agree to indemnify and hold us harmless from any claims or losses arising from your breach of these Terms or your unlawful use of the App.

IX. CHANGES TO TERMS

We may update these Terms from time to time. When we do, we will revise the date and provide the new version in the App. Continuing to use the App after the update means you accept the revised Terms.
